Terms of Service

These Terms of Service (“Terms”) are an agreement between you and NoCheck (“NoCheck”, “we”, “us”, or “our”) and govern your use of the NoCheck mobile app and the website at nocheck.app (together, the “Service”).

Please read them carefully. By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

These Terms also serve as the end-user licence agreement (EULA) for the app.

1. Who may use NoCheck

You must be at least 18 years old to create an account, use the Service, and make purchases. By using the Service you confirm that you are 18 or older and that you are able to enter into a binding contract with us.

2. What NoCheck is

NoCheck is a tool that helps you keep track of your vehicles and their maintenance — adding vehicles to a garage, recording readings and services, and getting reminders when maintenance may be due based on distance, engine hours, or time. NoCheck is offline-first: your data is stored on your device, and (for Premium subscribers who enable it) optionally backed up to the cloud.

Important: NoCheck provides information, not professional advice. The reminders, intervals, and maintenance suggestions in NoCheck are general guidance and default estimates only. They are not a substitute for your vehicle manufacturer’s official maintenance schedule, your owner’s manual, or the advice of a qualified mechanic or professional. You are solely responsible for your vehicle’s maintenance, roadworthiness, and safety. Always follow the manufacturer’s schedule and consult a professional for anything affecting safety. Do not rely on NoCheck alone for any safety-critical decision.

3. Your account

NoCheck requires an account: you sign in with Google, Apple, or a passwordless email link before using the app. You are responsible for keeping access to your sign-in method secure and for activity that happens under your account. Sign-in and account handling are described in our Privacy Policy. Notify us at support@nocheck.app if you believe your account has been compromised.

4. Licence to use the app

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to download and use one copy of the NoCheck app on devices you own or control, for your own personal, non-commercial use. We (and our licensors) retain all rights, title, and interest in the Service; these Terms do not transfer any ownership to you.

5. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in breach of these Terms;
• copy, modify, distribute, sell, or lease any part of the Service, or reverse-engineer or attempt to extract its source code, except where the law permits;
• interfere with, disrupt, overload, or attempt to gain unauthorised access to the Service or its backend, or circumvent our security or app-integrity measures;
• use the Service to store or transmit anything unlawful, infringing, or harmful; or
• use the Service on behalf of anyone else, or resell access to it.

6. Your content

The data you enter — your vehicles, readings, service logs, notes, and settings (“Your Content”) — belongs to you. You grant us only the limited licence needed to store, back up, sync, and display Your Content to you so we can provide the Service (for Premium backup, this includes storing a copy in the cloud). We do not use Your Content for any other purpose. You are responsible for Your Content and for having the right to store it. Any photo you add to a vehicle is part of Your Content, and you confirm you have the right to use it.

7. Free and Premium plans

NoCheck offers a free plan and a paid Premium plan.

• Free — includes full tracking, reminders, and history for one vehicle, stored on your device.
• Premium — raises the limits (currently up to 25 vehicles and 100 custom maintenance types) and adds cloud backup and sync across your devices. The current features and limits of each plan are shown in the app and may change over time as described in Section 12.

8. Subscriptions, billing, and cancellation

Premium is offered as an in-app purchase through the Apple App Store, Google Play or the Samsung Galaxy Store. All payments are processed by Apple, Google or Samsung, not by NoCheck. We never receive or store your payment details.

Plans. Premium is available as an auto-renewing monthly subscription, an auto-renewing annual subscription (which may include a free trial), and a one-time “Lifetime” purchase. The exact plans, prices, billing periods, and any free-trial terms are shown in the app at the time of purchase, in your local currency, as set by the app store.

Auto-renewing subscriptions. For monthly and annual plans:

• Payment is charged to your Apple, Google, or Samsung account at confirmation of purchase.
• Your subscription renews automatically at the same price for the same period unless you cancel it at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription in your App Store, Google Play or Galaxy Store account settings. Cancelling stops future renewals; it does not retroactively refund the current period, and you keep Premium until the end of the period you have paid for.

Free trial. If a plan includes a free trial, any unused portion of the trial is forfeited when you purchase that subscription. Unless you cancel at least 24 hours before the trial ends, the trial automatically converts to a paid subscription and your account is charged.

Lifetime purchase. The Lifetime option is a one-time purchase (not a subscription) that grants Premium access for as long as NoCheck offers the Service. It does not auto-renew.

Refunds. Because purchases are processed by the app stores, refunds are subject to Apple’s, Google’s, and Samsung’s policies and are requested through them. If you are a consumer in the EEA, the UK, or another jurisdiction with statutory cancellation or “cooling-off” rights, those rights are not affected by this section; note that by starting to use digital content immediately you may agree that such rights end once delivery has begun.

Price and plan changes. We may change prices or the contents of a plan for future billing periods. Where required, we will give you notice and the chance to cancel before a change takes effect; changes never alter a period you have already paid for.

9. Data, backups, and availability

NoCheck is offline-first. On the free plan your data is stored only on your device, and we do not hold a copy — if you uninstall the app, reset, or lose your device, that data may be lost. You are responsible for your own device backups. Cloud backup and sync are a Premium feature and, while we work to keep them reliable, we do not guarantee that a backup will always be available, complete, or error-free. Keep independent records of anything important to you.

The Service may be unavailable from time to time for maintenance, updates, or reasons beyond our control, and we may modify or discontinue features.

10. Intellectual property

NoCheck, its name, logo, design, software, and content are owned by us or our licensors and protected by intellectual-property laws. Except for the licence in Section 4, these Terms grant you no rights in our intellectual property. The vehicle make/model catalog includes data from public and third-party sources under their respective terms.

11. App stores and third-party services

The Service relies on third-party platforms and services, including Apple, Google, Samsung, and our providers listed in the Privacy Policy. Your use of those is subject to their own terms, and we are not responsible for them.

Apple App Store. If you obtained the app from the Apple App Store, the following additional terms apply:

• These Terms are concluded between you and NoCheck only, not with Apple. Apple is not responsible for the app or its content.
• Your licence to use the app is limited to a non-transferable licence to use it on any Apple-branded device you own or control, as permitted by the App Store Usage Rules, except that it may be accessed by other accounts via Family Sharing where enabled.
• NoCheck, not Apple, is solely responsible for the app and for providing any maintenance and support for it. Apple has no obligation to furnish support.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• NoCheck, not Apple, is responsible for addressing any claims relating to the app, including product-liability, legal or regulatory, and consumer-protection claims, and any claim that the app infringes a third party’s intellectual-property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
• For questions or complaints about the app, contact NoCheck at support@nocheck.app.

Google Play. If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service.

Samsung Galaxy Store. If you obtained the app from the Samsung Galaxy Store, your use is also subject to the Samsung Galaxy Store terms.

12. Changes to the Service and these Terms

We may update the app and the Service, and we may change these Terms from time to time. When we make material changes to these Terms, we will update the “Last updated” date above and, where appropriate, notify you in the app. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not agree, stop using the Service and you may delete your account.

13. Suspension and termination

You may stop using the Service and delete your account at any time (see the Privacy Policy and nocheck.app/delete-account). We may suspend or terminate your access if you materially breach these Terms, use the Service unlawfully, or where necessary to protect the Service or other users. On termination, the licence in Section 4 ends; sections that by their nature should survive (including Sections 6, 10, 14, 15, 16, and 17) continue to apply.

14. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that reminders or maintenance guidance will be accurate, complete, or suitable for your vehicle. As stated in Section 2, NoCheck is not a substitute for professional advice or the manufacturer’s schedule. Nothing in these Terms excludes or limits any rights you have as a consumer that cannot be excluded or limited under applicable law.

15. Limitation of liability

To the fullest extent permitted by law, NoCheck will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or vehicles, or for any vehicle damage, injury, cost, or loss arising from your reliance on reminders or maintenance guidance in the app. To the extent we are liable, our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or USD 50. This section does not exclude or limit liability that cannot be excluded or limited under applicable law (such as liability for death or personal injury caused by negligence, fraud, or your non-excludable consumer rights).

16. Governing law and disputes

These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales, and you and we submit to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you retain the benefit of any mandatory protections and the right to bring proceedings in the courts of the country where you live under the law of that country; nothing in this section deprives you of those protections.

17. General

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• Severability. If any provision is found unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce a provision is not a waiver of it.
• Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or transfer of the Service.
• Language. These Terms were written in English. We may make translations available for your convenience; if a translation and the English version conflict, the English version prevails — except where the law of the country you live in says otherwise. If you are a consumer, nothing in this clause removes any right you have under mandatory local law to rely on a version in your own language.
